Fair Use Policy

  1. Our Broadband, Phone and Mobile Services are subject to our Fair Use Policy (“Policy”) which forms part of our Agreement for these Services.
  2. Our Policy has been developed by reference to average customer profiles, estimated customer usage of our Services and any other relevant data sources.
  3. From time to time, we and/or our Network providers may monitor customer usage patterns. If your usage of our Services:
    1. materially exceeds our estimated range of a typical customer usage over any day, week or month, (or other period of time as determined by us); or
    2. is likely to damage or negatively impact the performance of our network; or
    3. is inconsistent with the purposes for which we communicate our Services are designed for;
      then your usage will be deemed unfair, excessive and/or unreasonable.
  4. If in our reasonable opinion we consider your usage to be unfair, excessive and/or unreasonable, we may, without further notice, apply charges to your account for the excessive and/or unreasonable element of your usage and/or suspend, modify, restrict, or cancel your Service(s).
  5. For the avoidance of doubt, our unlimited or endless calling, texts or data is for person-to-person standard landlines and mobiles. Our Services exclude:
    1. calls to “0900”, “018”, “0161”, “0172” and “059” numbers, switched digital (data) calls, collect calls, and calling card calls; and
    2. activities such as auto-dialling, premium services, continuously call forwarding, tele-marketing, audio conferencing, bulk texting by machines, automated texting, and use of Cellular Trunking Units (including SIM boxes and GSM gateways), call centre or other activities that use our Services for commercial gain. All of these activities are considered unfair, excessive and/or unreasonable in accordance with this Policy.
  6. Where we offer any Services under a Plan or other Service (such as included voice or video calls, text or picture messages, data transfer and internet use via our Network), such use is offered for your personal or business purposes only. In no case does any Service allow for activities aimed at making profit from the Service itself or reselling the Service or using the Service in an unfair or excessive way and any such use of the Services by you is a breach of this Policy.
  7. We reserve the right to publish, without notice, additional terms and/or requirements relating to Fair Use that apply to some or all of the Services.
